Landesweites Erosionskataster kommt rechtzeitig

Mainz. 3. Februar 2010. (red). Ab dem 1. Juli 2010 gelten in ganz Deutschland die neuen Bestimmungen zur Erosionsvermeidung auf Flächen mit potenzieller Erosionsgefährdung. Nach den EU-Vorgaben von Cross Compliance (CC) sind Bewirtschaftungsstandards zum Erhalt der landwirtschaftlich genutzten Flächen einzuhalten, dazu zählt auch der Schutz des Bodens vor Erosion. Darüber informierte das Ministerium für Wirtschaft, Verkehr, Landwirtschaft und Weinbau in Mainz.

Bisher hat der Prämienbezieher dies gewährleistet, indem er vom 1. Dezember bis 15. Februar auf 40 Prozent seiner Fläche auf den Einsatz des Pfluges zur wendenden Bodenbearbeitung verzichtet hat. Diese Übergangslösung wird im kommenden Jahr durch Maßnahmen abgelöst, die sich wesentlich stärker an den tatsächlichen Gefährdungen orientieren. Das hat das rheinland-pfälzische Landwirtschaftsministerium mitgeteilt.

Dazu mussten alle landwirtschaftlichen Flächen in Rheinland-Pfalz entsprechend dem Grad ihrer potenziellen Erosionsgefährdung in ein so genanntes Erosionskataster eingetragen werden. Dieses Kataster sieht hinsichtlich der Gefährdung durch Wassererosion zwei Gruppen vor: CCW1 für „mittel erosionsgefährdet“ und CCW2 für „hoch erosionsgefährdet“. Alle anderen Flächen weisen keine oder nur eine geringe Erosionsgefährdung auf, hier sind keine speziellen vorsorgenden Maßnahmen notwendig.

Die Ausweisung der potenziellen Erosionsgefährdung erfolgt flurstücksbezogen. Der Flächenbewirtschafter kann frei entscheiden, ob er die möglichen Maßnahmen flurstücksbezogen oder schlagbezogen anwenden will. Die Maßnahmen auf dem Schlag richten sich nach der Erosionsgefährdung, die den höchsten Flächenanteil ausmacht.

Zur Berechung der potenziellen Wassererosionsgefährdung wurden die Faktoren Bodenart, Hangneigung und Erosivität durch Niederschlag im Modell berücksichtigt. Von untergeordneter Bedeutung ist in Rheinland-Pfalz die Winderosion, wodurch eine Ausweisung der Flächen nach dem Grad der Winderosion entfällt.

Ab Juli 2010 gelten demnach für erosionsgefährdete Flächen folgende Bewirtschaftungsauflagen:

• Wassererosionsgefährdungsklasse 1 (CCW1)
In der Zeit vom 1. Dezember bis zum 15. Februar dürfen diese Flächen nicht gepflügt werden. Nach der Ernte gepflügte Flächen sind vor dem 1. Dezember einzusäen. Dadurch wird während der Wintermonate eine Bedeckung des Bodens entweder mit Ernteresten der Vorfrucht oder mit im Herbst neu eingesätem Bewuchs erreicht. Werden die Flächen quer zum Hang bewirtschaftet, gelten die vorgenannten Auflagen nicht.

• Wassererosionsgefährdungsklasse 2 (CCW2)
Flächen mit einer hohen Erosionsgefährdung sollten möglichst das ganze Jahr über mit einer Pflanzendecke oder mit Ernteresten bedeckt sein. In der Zeit vom 1. Dezember bis zum 15. Februar besteht daher ebenfalls ein Pflugverbot. Im übrigen Jahresverlauf (16. Februar bis 30. November) darf die Fläche nur gepflügt werden, wenn unmittelbar danach eine Aussaat erfolgt. Vor der Aussaat von Reihenkulturen ab mindestens 45 cm Reihenabstand (zum Beispiel Rüben, Mais, Kartoffeln) darf der Pflug nicht eingesetzt werden.

Ist die Ackerfläche in eine Fördermaßnahme zum Erosionsschutz einbezogen, ist der Bewirtschafter von den Auflagen ausgenommen, da die geförderten Maßnahmen bereits über die Anforderungen der „guten fachlichen Praxis“ hinausgehen. Dies betrifft vor allem Agrarumweltmaßnahmen des Landes wie Mulch- und Direktsaatverfahren, die einen entsprechend guten Erosionsschutz sicherstellen.

Die Bekanntgabe der nach CC erosionsgefährdeten Ackerflächen und deren Erosionsgefährdungsklassen erfolgt im Jahr 2010 ab dem 01.02.2010 für jeden Bezieher von Flächenprämien zusammen mit weiteren Informationen in dem Internetportal www.flo.rlp.de

. Zusammen mit den Unterlagen zum Antrag auf Direktzahlung und Agrarförderung werden diese Informationen durch die Kreisverwaltungen auch in Papierform den Prämienbeziehern zugestellt. Das Landwirtschaftsministerium wird die Daten rechtzeitig vor dem 15. Mai 2010 den Flächenbewirtschaftern zugänglich machen. Denn zur Antragstellung ist es erforderlich, bereits für den Winter 2010/11 die Anbau- und Bewirtschaftungsmaßnahmen planen zu können.

Mit den geänderten CC-Anforderungen werden die durch die EU geforderten Mindeststandards zum Bodenschutz umgesetzt. Sie sollen dazu beitragen, auf den gefährdeten Ackerflächen den notwendigen Erosionsschutz zu sichern. Unabhängig davon sind weiterhin die Bestimmungen des Bundes-Bodenschutzgesetzes (BBodSchG) und die Anforderungen einer landwirtschaftlichen Bodennutzung nach „guter fachlicher Praxis“ in der Landwirtschaft auf allen Ackerflächen zu beachten. Das in Rheinland-Pfalz eingeführte System ermöglicht den Betriebsleitern eine ausgesprochen flexible Handhabung, die in vollem Umfang das Ziel des Erosionsschutzes erfasst. Die Dienstleistungszentren Ländlicher Raum und das LGB sind angewiesen, bei der Ersteinführung umfassend Hilfestellung zu leisten.

State of Colorado Settles Case After Violating Constitutional Rights of Supporter of Personhood Amendment

DENVER, Feb. 2 /Christian Newswire/ — Last week the State of Colorado settled the case of Wiechec v. Hemphill, in which two Colorado State Troopers and a member of Governor Bill Ritter’s staff were accused of violating the constitutional rights of Mr. John Wiechec. On October 7, 2008, these individuals were complicit in preventing Mr. Wiechec from engaging in expressive First Amendment activity in support of Amendment 48, Colorado’s Personhood Amendment, while at a public park near the West Steps of the Colorado State Capitol building. The measure redefined „person“ to include an unborn child from the moment of conception.

In October 2009, attorney James Rouse, who is representing Mr. Wiechec, filed a complaint in the U.S. District Court for the District of Colorado naming the troopers and Governor Ritter’s staff member as defendants for causing the unlawful arrest of Mr. Wiechec. When you argue that Scott Roeder’s motivation for killing George Tiller entitles him to a slap-on-the-wrist sentence of less than five years in prison (the minimum sentence for voluntary manslaughter under Kansas law) you are trivializing premeditated murder and expressing support for violence against abortionists.

Against this background, your press conference claim that „I don’t even agree with what Scott Roeder did“ is absurd. It is the sort of self-serving fig leaf which thoughtful listeners will rightly reject. You are either being intentionally deceptive or wildly negligent.

You have every right to bring discredit upon yourself and the organization you represent. But when your self-promotional excesses discredit the entire pro-life movement with reckless theatrics, it would be irresponsible for the rest of us to signal indifference, or worse, agreement, by our collective silence.

When you attempt to rationalize, justify, or minimize violence against abortionists, you don’t speak for those of us who condemn anarchy without equivocation. Be assured that when you jeopardize the fragile progress we have all worked so hard to achieve, we will anathematize and isolate you.

There is much more I could say but to the extent that one believer can properly exempt another from the prohibition against lawsuits found in 1 Corinthians 6:1- 8, I do so with this rebuttal. Sue me.

I am more than willing to submit for judicial review my conclusions concerning your outrageous remarks. But in the mean time, be assured that many people are praying that you will abandon the erratic, destructive extremes toward which you seem increasingly inclined.

You greatly underestimate the injury caused by ill- considered remarks which encourage further violence on both sides of this volatile issue. You say „the sky is not falling“ but it fell indeed on CBR volunteer James Pullion when he was murdered by an abortion rights extremist whose defenders will attempt to make his trial about the public display of abortion photos in the same manner you tried to make Scott Roeder’s trial about abortion. It is clear that you don’t begin to understand the forces you are unleashing here.
